In this survey, we would like to find out what the public know and think

about the police use of their powers to “stop and search” people in the street.

We also want to understand if the powers are being used fairly and effectively

to fight crime and in a way that gives people confidence in policing.

Below is an explanation about police officer powers to stop and search people in the street.

Please read this carefully and then answer the questions that follow.

1.  Police officers have a legal power to search people if they have reasonable grounds to suspect the person is in illegal possession of an article.

2.  The purpose of these powers is to either prove or disprove the officers suspicions, without having to make an arrest. The police officer must provide an explanation to the person being searched and record the details.

3.  The powers must be used responsibly, with respect for those being searched, and without unlawful discrimination. The detention of the person should be short, and the search should take place at or near to the location of the stop

If a person is merely spoken to, and there is no search of the person or car it  is NOT a ‘stop and search’.

If a person is stopped for motoring related matters – even if the car is inspected (for example, to check tyres) – this does NOT constitute a stop and search.
